中国首例“过劳死”案在上海开审中新网上海10目19日消息:中国首例“过度疲劳致死”诉讼案,由上海市静安区人民法院于近日开庭审理。死者唐英才,生前系上海市静安区第六粮油食品公司员工。1998年8月14日,时年56岁的唐英才在夜间值班时突然死亡。经法医鉴定,死者系在有病的情况下,因高温或疲劳导致机体功能失去补偿而死亡。死者家属认为,单位安排的繁重工作是致死者死亡的真正原因,遂将死者所在单位告上法庭,并要求近20万元的赔偿。由于中国现行法律尚未针对“过劳死”制定相关法律,开庭审理过程中,原被告双方也对这一问题争执不下。被告律师指出,“过劳死”是指以暴力方式压迫个人在恶劣环境中长期劳动导致死亡,在当代只能以违法方式表现出
