新中国初期,为了实现社会主义并解决当时迫在眉睫的房荒问题,政府采取了将私有出租房屋国有化的社会主义改造政策。由于这一政策背离了社会经济发展规律,侵害了私房主的合法财产权,不但未能根本解决当时的住房问题,还造成民众私权意识的衰微,直至发展到“文化大革命”中更为恶劣的“抢房运动”。私房改造运动遗留的诸多问题,更给改革开放以后的社会稳定埋下了隐患。这一史实说明,想以抑制甚至侵害私权的方式实现人权,是不可能的,也是不科学的。
In the early days of New China, in order to realize socialism and solve the imminent shortage of housing at that time, the government adopted a socialist transformation policy of nationalizing private rented houses. Since this policy departed from the law of social and economic development and infringed upon the legitimate property rights of private homeowners, it not only failed to fundamentally solve the housing problem at the time but also caused the decline of public awareness of private rights until it reached the “Cultural Revolution” Bad “room-grabbing movement ”. Many problems left over by the private housing reform movement have laid a hidden danger for the social stability after the reform and opening up. This historical fact shows that it is impossible and unscientific to try to achieve human rights in a way that inhibits or even infringes on private rights.
