关于不动产的最优化立法始终是人们所共同追求的终极目标之一,设立国家对不动产物权进行统一的登记和管理,是近现代各国普遍适用的一种旨在保护不动产变动的管理制度。但任何一种制度的制定和实施都有其存在的必要和优势,同时每种制度又都存在着自身的缺陷和不足,也正因为此,作为我国不动产物权公示的一种手段,保障社会不动产交易安全和高效的不动产登记制度在现实运用中也存在着不足和缺陷。本文目的为如何避免这种因缺陷和不足而产生的不动产物权变动登记所带来的消极后果,达到登记的法律效果,从而为今后我国不动产登记条例实施过程中政府必须要面对和解决的一大现实问题。
The optimization of real estate legislation is always one of the ultimate goal pursued by people. The purpose of this paper is how to avoid the negative consequences brought about by the registration of real property changes caused by the defects and shortcomings so as to achieve the legal effect of registration so that for the future implementation of the real estate registration regulations in our country, the government must face and solve A big practical problem.
