欧洲一体化的道路漫长而艰辛,欧盟宪法未能通过便是最大的例证。尽管如此,一体化所实现的整合程度不可能停步或者走回头路。事实上,欧盟以及相应的机构正承担着这一重任,如欧洲法院权力不断增长导致主权明显地从成员国家向超国家机构移转,其越来越类似于美国的联邦最高法院。本文以马伯里诉麦迪逊案为分析框架,借用的则是现代国家宪政制度中所惯常使用的“违宪审查”或“司法审查”的路径,探讨欧洲联盟横向与纵向的审查实践及其存在的问题。
The road to European integration is long and arduous, and the failure of the EU constitution to pass is the single largest example. In spite of this, the level of integration achieved by integration can not stop or go backwards. In fact, the EU and its corresponding agencies are shouldering this task. For instance, the growing power of the European Court of Justice has resulted in the apparent transfer of sovereignty from member states to supranational institutions, more and more similar to the United States federal supreme court. This article takes Marbury v. Madison as the frame of analysis and borrows the path of “unconstitutional review” or “judicial review” which is commonly used in the constitutional system of modern countries and explores the horizontal and vertical review practice and its existence of the European Union The problem.
