中国是后发型法治现代化国家,其构建法治政府的动力来源于政府凭借理性进行制度设计加以推进,借此发挥政府理性的优势,确保政府推进不至于偏离方向。但是,在现有的学术观点及评估实践中,法治政府与生态文明并未被关联起来,二者仍然处于简单的平行关系。这与目前环境破坏、资源告急已然危及政府安全的事实,以及党的政策文件的最新决策和论断并不相符。由于生态秩序是政府理性的应有之义,而政府理性又是生态秩序的坚实保障,法治政府与生态文明之间应当是复杂的螺旋结构,必须将生态文明建设纳入法治政府建构的整体思路之中。生态文明建设对于法治政府建构而言既是理念目标,也是重要内容,还是检验手段,需要在法治政府建构的三个层面——价值基准、指标设计和实践反哺分别加以展现。
China is a post-hairstyle country under the rule of law. Its motivation for building a government ruled by law stems from the government’s institutional design based on rationality that advances the government’s rational superiority and ensures that the government will not deviate from its direction. However, in the existing academic viewpoints and evaluation practices, the relationship between the government under the rule of law and ecological civilization has not been linked and the two are still in a simple parallel relationship. This is not in line with the fact that the current environment is damaged, the emergency of resources is already endangering the security of the government, and the latest decisions and judgments of the party’s policy documents. Since ecological order is the proper meaning of government rationality and government rationality is a solid guarantee of ecological order, the government of the rule of law and the ecological civilization should be a complex spiral structure, and the construction of ecological civilization must be integrated into the overall idea of building a government under the rule of law in. The construction of ecological civilization is not only the ideal goal but also the important content or the test means for the construction of the government by law. It needs to be demonstrated separately on the three levels of the construction of the government by law - value benchmarking, index design and practice feedback.
