在司法实践中,文字作品虚构角色因其存在载体的特殊性,在思想表达二分法的判断中被倾向于认定为不受保护的“思想”而非受保护的“表达”。而美国法院在一定程度上认可文字作品虚构角色具有可版权性,在判例中创制了多种判断标准。本文试以美国第九巡回法院提出的“三部分检测”标准为基点,探讨文字作品虚构角色版权保护问题。
In judicial practice, the fictional character of a written work tends to be identified as unprotected “thoughts” rather than protected “expressions” in the judgment of the dichotomy of ideological expression because of the particularity of its existence carrier. The U.S. courts, to a certain extent, accepted the copyrightability of fictional characters in written works and created a variety of criteria in their jurisprudence. This paper tries to discuss the copyright protection of fictional characters in writing based on the “three-part test” standard put forward by the Ninth Circuit of the United States.
