随着城市化进程的发展和国民经济水平的提高,停车位的归属问题成为现代建筑物区分所有制度的重要问题。本文首先将对小区停车位的物权性质进行类型化分析,之后阐述我国《物权法》关于停车位相关规定的优势与不足,而后介绍域外国家和地区关于停车位的相关规定,最后针对我国《物权法》规定的不足和缺陷提出相关的立法建议和实际解决方案,以期对《物权法》第74条的正确适用和解决车位纠纷有所裨益。
With the development of the urbanization process and the improvement of the national economy, the ownership of parking spaces has become an important issue in the differentiation of all systems in modern buildings. This article first analyzes the type of property right of parking spaces in residential areas, and then elaborates the advantages and disadvantages of the relevant provisions of the “Real Right Law” of parking spaces in our country, and then introduces the relevant provisions of foreign countries and regions about parking spaces.
