1960年代中期是欧美比较法的黄金时代,大师荟集,群星闪耀。1970年代以后,尽管在欧洲大陆和英美出现了一些著名的作者与著述,但比较法开始衰落。这主要表现为缺乏关键性的专题和方法的创新,其根本原因在于比较法黄金时代的杰出学者们没有为后代留下比较法学教育、研究与实践的方法,致使比较法学科欠缺牢固的根基。比较法研究需要注重方法研究,否则它完全可能枯萎下去。
The mid-1960s was the golden age of the comparative law between Europe and the United States. The masters gathered and the stars shined. After the 1970s, despite some famous authors and writings in continental Europe and the United States and Britain, comparative law began to decline. This is mainly manifested in the lack of key themes and methodological innovations. The fundamental reason for this is that outstanding scholars in the Golden Age of Comparative Law did not leave comparative legal education, research and practice methods for future generations, leaving comparative law disciplines lacks a solid foundation. Comparative law research needs to focus on methodological research, otherwise it is entirely possible to wither.
