本文从决定香港特区政治体制的宪政原理出发,论证《香港基本法》对香港政治体制的制度设计规范体系,指出国家授权前提下香港特区作为地方行政区域在行政、立法、司法方面的“高度自治”并非完整独立的体系,均受到中央权力的节制和规限,三权之上有第四权即中央的管辖权。并据此推导出在没有明晰前提下不宜简单借用“三权分立”概念来描述香港特区政治体制模式特征的结论。
Based on the constitutional principle that determines the political system of Hong Kong Special Administrative Region, this article argues that the Basic Law of Hong Kong designs a system of standardizing the constitutional system of Hong Kong and points out that under the prerequisite of state authorization, the “Hong Kong SAR,” as a high degree of autonomy in administrative, legislative and judicial affairs, “Is not a complete and independent system, are subject to the restraint and restrictions of the central power, the fourth right above the three rights that the central jurisdiction. Based on this, it is deduced that the concept of ”separation of powers" should not be simply used to describe the characteristics of the model of the SAR’s political system without clear definition.
