我国《物权法》确定了一项新制度即动产浮动抵押制度。现行《物权法》仅在第181条和196条专门针对动产浮动抵押问题作出了原则性的规定,但是却缺乏相应的执行依据,本文试对相关规定进行剖析并借鉴他国的做法予以分析。本文主要内容是从浮动抵押的标的物范围和抵押权实现时如何确定抵押物的范围两方面解决浮动性问题。
China’s “Property Law” has identified a new system that is movable floating mortgage system. The current “Property Law” only provides for the principle of Article 181 and Article 196 specifically for the issue of movable property floating mortgage, but lacks the corresponding enforcement basis. This article attempts to analyze the relevant provisions and learn from the practices of other countries. The main content of this article is to solve the problem of floating from two aspects: the scope of the subject matter of floating charge and the scope of the mortgage when the mortgage right is realized.
