倘若要选取一部反映转型中国法制现状的立法,今年10月1日起正式实施的物权法,无疑是一个最具考察价值的样本。作为一部与民众财产权益息息相关的权利法典,也许没有一部法律像物权法这般经历了如此复杂变幻的博弈过程,也没有一部法律像物权法这般唤起了如此汹涌澎湃的维权热情。更耐人寻味的是,物权法自今年3月16日诞生后,在长达半年多的“实施准备期”内,屡遭难题,波澜四起。从举世瞩目的“最牛钉子户”事件到沸沸扬扬的“小产权房”风波,再到纠缠不清的小区物权纠纷,它们或揭开了未决的立法悬念,或触及了现实的物权“死结”。所有这一切,都以最直观的方式检测着物权法,也等待着法律更加及时、更为明晰的答案。对于已经正式实施的物权法而言,考验,才刚刚开始!
If we want to select a piece of legislation that reflects the status quo of the legal system in transition in China, the Real Right Law, which came into effect on October 1 this year, is undoubtedly the most valuable sample for investigation. As a code of rights closely related to people’s property rights, there may not be a law that has undergone such a complicated process of change as Property Law. And no law like the Property Law arouses so much enthusiasm for protecting human rights. Even more intriguing is that the property law since its inception on March 16 this year, more than six months in more than “implementation preparation period”, repeated challenges, waves of four. From the world’s most notorious “nails” incident to the uproar “small property room” turmoil, tangled cell disputes, or they opened the pending legislative suspense, or touted Real right “Knot ”. All of this tests the property law in the most intuitive way and awaits more timely and clear answers to the law. For the property law that has been formally implemented, the test has just begun!
