武装冲突中的失踪人员问题是习惯国际人道法的一个重要问题。习惯国际人道法确立了家人了解报告亲属下落的权利义务以及冲突各方查找和报告武装冲突中失踪人员信息的义务。2006年《保护所有人免遭强迫失踪公约》代表着国际社会在人权保护领域的又一重要进展,并建立了有关制度,该公约并不影响习惯国际人道法关于武装冲突中的人员失踪的规定及其适用,而且还会引起人们对关于失踪人员的国际人道法的进一步关注。在查找全球武装冲突地区失踪人员的实践中,红十字国际组织发挥了巨大作用。冲突后一些国家设立了特别委员会和其他寻人机制,这些行动均丰富了武装冲突中失踪人员查找的实践。
The issue of missing persons in armed conflicts is an important issue of customary international humanitarian law. Customary international humanitarian law establishes the family’s obligation to understand the whereabouts of the relatives of the reported individuals and the obligation of all parties to the conflict to locate and report on the missing persons in armed conflicts. The 2006 Convention for the Protection of All Persons from Enforced Disappearance represents yet another important advance in the area of human rights protection by the international community and has established a system that does not affect customary international humanitarian law provisions concerning the disappearance of persons in armed conflicts And its application, but it also raises further concerns about international humanitarian law on missing persons. The ICRC has played a huge role in finding out about missing persons in areas of global armed conflict. In post-conflict countries, special commissions and other tracing mechanisms have been established, all of which have enriched the practice of finding missing persons in armed conflicts.
