住房不仅是一种商品,更是一种基本人权所需。以保障公民住房权作为国家住房政策的制定依据,既是履行国家义务的必然要求,也是提高国家住房政策效力、避免住房政策出现偏误或波动的可靠法则。住房政策本质上属于一种社会福利政策。我国住房领域存在的许多问题,本质上是由于当前住房政策只看到了住房的商品属性而忽略了住房的社会权利属性造成的。重建住房政策的公民住房权之基础,不仅可以从根本上提升我国公民基本权利保障水平,也有助于解决我国住房社会福利体系中的一些体制性和结构性问题。 Housing is not only a commodity, but also a basic human right. In order to guarantee the housing rights of citizens as the basis for the formulation of national housing policies, it is both an inevitable requirement of fulfilling state obligations and a credible rule of raising the effectiveness of national housing policies and avoiding any bias or fluctuation in housing policies. Housing policy is essentially a social welfare policy. Many problems existing in the field of housing in our country are essentially caused by the fact that current housing policies only see the commodity attributes of housing and neglect the social rights attributes of housing. The basis for the reconstruction of housing policy for citizens ’housing rights not only can fundamentally enhance our citizens’ basic rights protection, but also help to solve some institutional and structural problems in China’s housing social welfare system.
