德国刑事诉讼法第 14 2条规定了一种独特的选择辩护人制度 ,赋予被告人选择他所信任的律师作为其指定辩护人的权利 ,并且建立相应的制度予以保障。这对于完善我国刑事诉讼中的指定辩护制度 ,加强对被告人之人权保障具有重要的借鉴意义。 Article 14 2 of the German Code of Criminal Procedure provides for a unique system of choice of defenders, giving the accused the right to choose the lawyer he trusts as his designated defender and establishing a system of protection. This is of great significance to the improvement of the designated defense system in China’s criminal procedure and to the enhancement of the defendant’s human rights protection.
