欧盟是当今区域一体化代表性最高的国际组织,是思想和观念上的规范性权力。欧盟自身所具备的特殊性,主要体现在欧盟法自成一体的法律体系,特别是在共同体法与成员国法之间的关系上。Van Gend en Loos案中确定的欧盟法的直接适用原则在欧盟法的发展历程上产生了重大推动作用。本文以该案为例,分析了欧盟法与一般国际法的异同,深入探究了欧盟法制的特点。
The EU, as the most representative international organization in regional integration today, is a normative authority in ideas and concepts. The peculiarity of the EU itself is mainly reflected in the self-contained legal system of EU law, especially the relationship between Community law and member state law. The principle of direct application of the EU law as determined in the case of Van Gend en Loos has played a significant catalytic role in the development of the EU law. Taking the case as an example, this article analyzes the similarities and differences between EU law and general international law and probes into the characteristics of the EU legal system.
