经济全球化是一把双刃剑,既促进了金融的快速发展,同时也给国际金融市场带来新的风险。各国的金融法制都是利己性的,不利于真正降低金融市场的风险,信息的不真实性和监督的缺乏也严重阻碍了国际金融法的实施。近年来,尤其是在上一轮金融危机之后,国际金融法治有了较大的变革和发展,在国际金融机构和国际金融监管领域以及国际货币体系领域等表现比较明显。在这些领域的发展中,体现出了国际金融法治的主体多元化、发展价值取向稳定和权力义务规则化等特点。根据国际金融法治的发展来看,国际金融监管更趋于集中化,金融法治更加注重发展和公平化,国际金融法的硬效力也会大幅度强化。
Economic globalization is a double-edged sword that not only promotes the rapid development of finance but also brings new risks to the international financial markets. Every country’s financial legal system is self-serving, is not conducive to truly reduce the risk of financial markets, the information is not authentic and the lack of supervision has also seriously hindered the implementation of international financial law. In recent years, especially after the last round of financial crisis, the rule of international financial law has undergone major changes and developments. It has become more apparent in the fields of international financial institutions, international financial regulatory fields and the international monetary system. In the development of these fields, it reflects the diversification of the main body of the international financial rule of law, the stability of development value orientation and the regularization of power obligations. According to the development of international financial law and order, international financial regulation tends to be more centralized. Financial law and order pay more attention to development and equity, and the hard effectiveness of international financial law will be greatly strengthened.
