我国实行世界上最严厉的耕地保护制度及规划管制措施,强化对耕地资源及基本农田的保护。然而,实施强制性的管制政策及保护措施时却缺乏配套的经济补偿机制设计,政策的不完善易造成社会不公或滋生寻租行为,带来区域社会经济发展的非均衡及相关利益群体的福利损益影响。本文在详细分析我国土地规划管制制度逐渐强化的协同演变路径基础上,重点探讨了规划管制发展受限制下相关利益群体福利非均衡的制度缺陷,同时建议规划制度设计时应尊重产权主体的土地发展权利,保障其土地财产权益;建立管制弱化区对管制强化区的经济补偿转移机制,缩小区域差距,强化区域分工及促进社会经济与生态环境的协调发展;加大对地方政府违法、违规用地的查处力度,健全规划管制成效的考核机制,不断优化国土空间布局。
Our country implements the strictest system of arable land protection in the world and plans and controls measures to strengthen the protection of cultivated land resources and basic farmland. Based on the detailed analysis of the path of synergistic evolution of land regulation control system in China, this paper mainly discusses the institutional defects of the unbalanced welfare of stakeholders under the restricted development of planning control. At the same time, it is suggested that the planning system should be designed with respect to land development Rights and protect their land property rights and interests; establish a mechanism to control the economic compensation and transfer of weak areas to strengthen the area, narrow the regional disparities, and strengthen regional division of labor and promote the coordinated development of social economy and ecological environment; increase the illegal use of local governments Investigate and punish efforts to improve the effectiveness of planning control assessment mechanism, and constantly optimize the layout of land and space.
