This paper begins with a discussion of Hayek’s division of nomos and thesis, emphasizing that the former is central to both the market and the establishment of spontaneous order around the world. Then, the article distinguishes between the two legal characteristics that accompany the process of globalization into the field of vision. One is born in the universal concept, the other is based on the function of the world. The latter highlighted the fact that the professional community formed by experts has fragmented the entire world into pieces. Nomos’ support for the community reinforces this fragmentation. As a formal political form of publicity, justice should be reopened to individuals excluded from the community in order to achieve universal justice. Finally, this dissertation rejects Hayek’s division of nomos and thesis in this investigation.
