在物上设定抵押权之后,在抵押期间,抵押人未经通知或者未经抵押权人同意转让抵押物的效力,我国担保法和物权法以及担保法司法解释都进行了规定,但在解释适用中还有许多疑义需要进一步明确。本文以(2008)民一终字第122号民事判决为评析对象,就未经通知或者未经抵押权人同意转让抵押物的效力问题进行探讨。
