“美国能否借超级高铁实现弯道超车?”此类问题近几年受到各方的密切关注。中、美相关技术领域重要申请人的专利布局对两国在该领域的竞争中起到非常关键的作用。本文从专利申请数量与类型、地域保护范围、潜在技术和市场价值、专利布局方式的选择、核心专利技术分析五个方面对Hyperloop One与西南交通大学在该领域专利布局情况作了深入分析。通过该分析得出:Hyperloop One关注领域相对较为分散,其在该领域在美专局及国际局提出专利申请;西南交通大学关注领域相对较为集中,其在该领域仅在中国国家专利局请求了专利保护;同时两家申请人都具有较高潜在技术和市场价值的专利申请,在该领域技术研究的专利布局上均存在空白点。
“The United States can achieve super-high-speed rail overtaking? ” Such issues in recent years by all parties closely watched. The patent layout of important applicants in relevant technical fields in the United States and China plays a very crucial role in the competition between the two countries in this field. This paper analyzes the layout of Hyperloop One and Southwest Jiaotong University in this field from five aspects of the number and type of patent applications, the scope of geographical protection, potential technology and market value, the choice of the layout of patents and the analysis of core patents. According to this analysis, the Hyperloop One field of focus is relatively fragmented, and its patent applications are filed in the U.S. Bureau and the International Bureau. Southwest Jiaotong University’s field of focus is relatively concentrated, which is only requested by the State Patent Bureau Patent protection; At the same time both applicants have a higher potential technology and market value of the patent application, patent research in the field of technology there are gaps in the layout.
