高校学生申诉的制度化和规范化有利于及时消弭争议、救济权利。但是从现有的立法情况看,依然存在程序设计上的缺陷,尤其体现在学生申诉处理委员会的相关规定上。应该合理界定学生申诉处理委员会的人员构成,明确其工作原则以及受理、管辖、权限等问题,为学校的稳定发展和保护学生正当权益打下良好的基础。
The institutionalization and standardization of college students’ complaints are conducive to the timely elimination of disputes and the relief of rights. However, judging from the existing legislation, there are still some flaws in programming, especially in the relevant provisions of the Student Appeals and Disposal Committee. It is necessary to define the staff composition of the student appeal handling committee in a reasonable manner, clarify its working principles and issues such as admissibility, jurisdiction and authority, so as to lay a good foundation for the stable development of the school and the legitimate rights and interests of the students.
