循环经济是建立节约型社会,实现中国经济可持续发展的重要途径。法制建设是发展循环经济的制度保障。但现有的循环经济法制还不健全,基本的框架还没有完全建立起来,在一定程度上制约了我国循环经济的发展。要大力发展循环经济,必须要加强循环经济立法,建立循环经济的法律体系。在立法中,应遵循以国家统一立法,制定指导性原则；地方配合立法,落实具体措施的路径。
Recycling economy is to establish a conservation-oriented society, an important way to achieve sustainable development of China’s economy. Legal construction is the institutional guarantee for the development of circular economy. However, the current legal system of circular economy is still not perfect, the basic framework has not been fully established, to a certain extent, restricted the development of circular economy in our country. To vigorously develop circular economy, we must strengthen the circular economy legislation, the establishment of a recycling economy legal system. In the legislation, we should follow the principle of unifying the legislation with the state, formulating the guiding principles, formulating laws and implementing local specific measures.
