学术界对《保护原产地名称及其国际注册里斯本协定》存在错误认识,这限制了该协定在原产地名称国际保护中的作用。依照《维也纳条约法公约》中的解释规则对相关条款解释发现,相对于《与贸易有关的知识产权协议》的地理标志保护条款该协定对缔约国的要求并不太高。它并不要求缔约国必须制定保护原产地名称的专门法律;“质量或特征”属于原产地名称的选择性因素;原产地名称并不优先于在先权;一国可以拒绝保护其他成员国与在先权冲突或属通用名称的原产地名称。
The academic community misunderstood the Lisbon Agreement for the Protection of Appellations of Origin and its International Registration, which limited the role of the agreement in the international protection of appellations of origin.
