我国房地产经纪行业自律薄弱,现行的行政主管模式难见成效。政府管理部门通过采取各种法律、行政手段对房地产经纪业进行宏观管理是必要的。房地产经纪业务是丰富多彩的,行业协会自律以及政府监管不可能面面俱到。因此通过公民、社会舆论、社会团体等社会监督途径,可以发挥预防功能、矫正功能、惩戒功能、保健功能。行业自律、行政监管以及社会监督三个方面是我国房地产经纪业行业管理三位一体的基本框架,该模式是我国的合理选择。
China’s real estate brokerage industry self-discipline is weak, the current executive mode of hard-hit. Government departments through various legal and administrative measures to carry out macro-management of real estate brokerage industry is necessary. Real estate brokerage business is rich and varied, industry associations and government regulation can not cover everything. Therefore, through the social supervision channels of citizens, public opinion and social groups, it can exert preventive, corrective, disciplinary and health care functions. Industry self-regulation, administrative supervision and social supervision in three aspects of China’s real estate brokerage industry management trinity of the basic framework of the model is a reasonable choice for our country.
