死刑作为对犯罪分子最严厉的处罚,在我国的刑罚中一直处于独特的地位。但我国死刑制度罪名过多,涉及面过宽,已经不符合社会发展的需要。根据我国当前发展的实际情况,刑法修正案(八)删去了13个经济型非暴力犯罪的死刑罪名,严格限制死刑的适用,从而提高了我国保障人权的状况,顺应了时代发展的潮流,使我国死刑制度更趋完善,有效地推动了我国司法制度的改革。但我国的死刑制度还需要我们进一步研究,提出相关建议,使其更加完善。 As the most severe punishments on criminals, the death penalty has always been in a unique position in the penalty of our country. However, there are too many crimes in our country’s death penalty system, covering too many areas and no longer meets the needs of social development. According to the current situation of our country’s development, the amendment to the Criminal Law (8) deleted the death penalty for 13 economic non-violent crimes and strictly restricted the application of the death penalty, thereby enhancing the protection of human rights in our country and adapting to the trend of development of the times. Make our death penalty system more perfect, and effectively promote the reform of our judicial system. However, the death penalty system in our country still needs us to further study and put forward relevant suggestions to make it more perfect.
