美国对来自中国的进口商品同时适用反倾销、反补贴措施引发了巨大的争议。在没有美国国会明确规定的前提下,同时适用反倾销、反补贴措施不仅背离了对非市场经济国家(NME)不适用反补贴措施的传统,还导致了重复救济等问题。在中国将这一问题诉至WTO期间,美国国际贸易法院在“GPX公司诉美国案”即“非公路用轮胎案”(Off-the-Road Tires case)中,在反倾销、反补贴措施同时适用的问题上作出了有利于中国的裁决。
The United States has a huge controversy over the simultaneous application of anti-dumping and anti-subsidy measures to imported goods from China. Without the explicit stipulation of the U.S. Congress, the simultaneous application of anti-dumping and anti-subsidy measures not only departs from the tradition of not applying anti-subsidy measures to non-market economy countries (NMEs) but also causes problems such as repeated relief. While China filed the matter with the WTO, the United States Court of International Trade held a series of anti-dumping and anti-dumping activities in the “GPX Company v. United States” or “Off-the-Road Tires case.” Subsidies apply at the same time the issue of making a decision in favor of China.
