2008年元月1日起,《中华人民共和国城乡规划法》正式实施。宁夏作为民族区域自治地区,如何将国家法制统一原则与本地区实际情况与特点有机协调,制定相应的实施细则十分重要。本文从理论和实践两个方面,对其中某些条文规定及其价值取向进行研究,认为不应当给予具有行政级别大型经济实体规划编制制定权,并对有关审批前置程序设定的合理性提出质疑,同时就如何加强城乡规划中的公众参与问题提出自己的一点意见,供立法机构参考。
January 1, 2008 onwards, “People’s Republic of China Urban and Rural Planning Law” was officially implemented. As an autonomous region of ethnic autonomous regions, Ningxia is very important in how to coordinate the principle of the unification of national laws with the actual situation and characteristics of the region and formulate corresponding implementation rules. This thesis studies some of these provisions and their value orientation from two aspects of theory and practice. They think that it should not be given the power to plan and formulate a large-scale economic entity with administrative level, and put forward the rationality of the pre-approval procedure Questioned, at the same time on how to strengthen the public participation in urban and rural planning put forward their own opinions for reference by the legislative body.
