法律规避是国际私法领域一项重要的制度,自1787年法国最高院对“鲍富莱蒙”案的审理之后,法律规避便成为了国际私法学家们竞相研究的对象,但由于只有极少的国家将其明确规定在法条之中,这个制度只停留在理论层面,所以法院在处理涉外纠纷时经常会出现对其滥用以及与其他制度混用的现象,本文简略的将该制度与相类似的概念进行了比较,希望对理论及司法实践的发展起一定的帮助作用。
Legal evasion is an important system in the field of private international law.
