在共同犯罪中,有一类情况是犯罪分子没有像一般意义中的实行犯直接亲自实行犯罪行为,而是通过对第三人形成控制力利用他人作为自己的犯罪工具从而实施犯罪,这一类情况,如果认定为无罪显然对于受害者不公平,而通过传统的犯罪构成要件要素,又无法直接定刑。因此引用出间接正犯理论以解决现实中的特殊疑难案件。本文从间接正犯的理论基础、犯罪着手的认定等方面加以阐述,通过对日本以及我国刑法重要理论进行分析来阐明这一理论。
In the case of joint crimes, there is a situation where criminals do not commit crimes directly and personally, but rather act as criminals by using the others as their own criminal tools in the form of control over the third party If it is found that innocence is apparently unfair to the victim, it can not be directly sentenced through the elements of a traditional criminal component. Therefore, an indirect offender theory is cited to solve the special difficult cases in reality. This article expounds the theoretical basis of indirect offender and the determination of criminal proceeding, and clarifies this theory by analyzing the important theories of Japan and our country’s criminal law.
