(一)执法主体地位先天不足。主要表现为“监管范围太窄”、“执法地位不高”。虽然目前全市各地粮食局都取得了由市政府和政府法制办授予的粮食流通行政管理执法主体资格,但是,《粮食流通管理条例》中大部分条款不是由粮食行政管理部门来直接执行的,而是由工商、质检、物价、卫生等多个部门共同执行的,即或是由粮食行政管理部门执行的也只是监管原粮的收购、储存、出入库,其他环节无权监管。
