司法实践中判定商标侵权的要件之一是构成商标性使用,我国商标法在第三次修改时新增“识别商品来源”对商标使用进行限定,进一步明确了商标的标识区别功能。随着社会经济的发展和消费观念的改变,商标的功能也随之发生改变,攀附他人商标声誉的行为正是对商标非标识性利用的一种形式。在我国司法实践中,对于识别目的之外利用商标的行为,法院通常不认定构成商标侵权,多适用反不正当竞争法为商标权人提供法律救济。因此,本文从商标法和反不正当竞争法的视觉对商标声誉攀附行为进行法律制度层面的分析。
Judicial practice to determine one of the elements of trademark infringement constitutes a trademark use, China’s Trademark Law in the third revision of the new “Identify the source of goods ” to limit the use of trademarks, to further clarify the trademark logo distinguishing function. With the socio-economic development and changes in consumer attitudes, the functions of trademarks also change. The act of clinging to another’s trademark reputation is just one form of non-symbolic use of trademarks. In our country’s judicial practice, for the purpose of identifying the purpose of using trademarks, the court usually does not consider the constituting of trademark infringement and applies the law of unfair competition more often to provide legal remedies to trademark owners. Therefore, this article analyzes the legal and institutional aspects of trademark reputation clinging from the perspectives of trademark law and unfair competition law.
