审判委员会是中国司法制度中一个独具特色的制度。在司法实践中,审判委员会存在案件审理简单化、法官选任待遇化和司法思维行政化三个缺陷。对此,已经开始摸索诸如细化审判委员会的讨论案件的范围、建立摆脱官职论位的专业委员会和完善开会制度等完善举措。此外,本文还探讨了完善审判委员制度的立法思考。 Trial committee is a unique system in China’s judicial system. In judicial practice, there are three defects in trial committee such as simplification of case trial, treatment of judges’ election and administration of judicial thoughts. In this regard, it has begun to explore such as the refinement of the trial committee to discuss the scope of the case, to establish a professional committee to get rid of official positions and perfect the meeting system and other measures to improve. In addition, this article also discusses the legislative thinking on how to perfect the system of adjudicators.
