海事赔偿责任限制制度可谓由来已久,各航运大国和航运区域或以单独制定或以参加国际条约等方式对其管辖下的内河及海上的航运业进行规制。我国《海商法》以专章形式将海事赔偿责任限制制度加以规定,但对内河责任限制的问题却未涉及。在内河船舶标准化率的逐渐提升的背景之下,内河赔偿责任限制制度该如何构建,俨然成为一个亟待解决的问题。鉴于此,本文对构建该制度的必要性和特殊性进行检视并对如何构建提出一些建议。
The system of limitation of liability for maritime claims has a long standing system in which major shipping and shipping regions regulate the inland waterways and the shipping industry under their jurisdiction either individually or through participation in international treaties. China’s “Maritime Law” to the form of a special chapter to limit the system of liability for maritime claims to be provided, but the limitation of the river’s problems have not been involved. Under the background of the gradual increase of the standardization rate of inland river vessels, how to construct the limitation of liability system for inland river compensation has become a problem to be solved urgently. In view of this, this article examines the necessity and particularity of constructing this system and puts forward some suggestions on how to construct it.
