迷信是一种文化现象,古已有之。后来随着社会的不断发展,迷信逐渐渗透到人们的日常生活,其中的一部分内容演变成风俗习惯,流传至今;另一部分内容则保留了神秘和荒诞色彩,这部分内容虽已为科学所证伪,但仍拥有众多信奉者,并被一些不法分子利用,进行违法犯罪,即迷信犯罪。本文通过阐释迷信的含义,对比迷信和宗教的异同,界定了迷信犯罪,以期在司法实践中,帮助执法者准确判定此类犯罪行为。
Superstition is a cultural phenomenon that has existed in ancient times. Later, with the continuous development of society, superstition gradually permeated into people’s daily life. Some of the contents have evolved into customs and have been handed down to the present day. The other part has retained the mysterious and absurd colors. Although this part has been falsified by science , But still has many followers, and was used by criminals to commit crimes against the law, namely superstitious crimes. By interpreting the meaning of superstition and comparing the similarities and differences between superstition and religion, this article defines the superstitious crimes, with a view to helping law enforcers to accurately determine such criminal acts in judicial practice.
