我国民事法律体系当中已经将无因管理的合法性进行了确立和认可,同时想要借此管理来监督其他管理行为的不合理性及违法情况,这恰好体现了公允至上的高贵法律精神。就无因管理的性质来看,它很明显是一种事实行为,而且还可以将其细分为真正无因管理和不真正无因管理这两种类型。真正无因管理当中又可以细分化成适法无因管理和不适法无因管理,而不真正无因管理则也可以细化成误信管理、不法管理和幻想管理。由于无因管理的种类众多,且各个类型又都分别各具特点,因此但凡是类型不同的无因管理,构成它们的要素也都不尽相同,他们所能够产生的法律效果自然更加大相径庭。
Among the civil legal systems in our country, no one has established and approved the legitimacy of management.
