随着社会经济不断发展,停车位的纠纷也日渐突出,其中最为人们所关注的当属住宅小区中的停车位问题,而随着住房的商业化,商业住宅小区逐渐代替之前老旧的单位分配宿舍成为居民居住的主要形式。《物权法》颁布之后由于对于小区停车位权属性质、使用、交易以及管理方面规定较为笼统,不适于直接用于实践中。在学界中有着不同的看法,在现实生活中经常出现法律纠纷。就域外,对于小区停车位的立法情况进行梳理,以便提供一种多样开放的思路对于住宅小区停车位的权属进行界定。
