我国保险法未明确保险合同成立、生效与保险费缴纳是否有直接因果关系,使得在实践中一旦出现这种情况,各个法院判决不一,使得投保人和保险人的利益无法得到很好的平衡,从合同法的一般原理和保险的理念出发进行论证,以期推进法制。
The insurance law in our country does not specify the existence of a direct causal relationship between the entry into force of insurance contract and the payment of insurance premium. As a result, in practice, the courts have different verdicts and make the interests of policyholders and insurers unable to be well balanced. Proceeding from the general principle of contract law and the concept of insurance, with a view to promoting the legal system.
