中国古代存在着历史悠久的法律诠释传统 ,这一传统形成于汉代 ,与经学的发展时代相当。与西方的注释法学比 ,中国古代的法律诠释传统有其自身的特征 ,它取决于中国古代政治文化与学术发展的特点。本文运用解释学的观点与方法对中国古代法律诠释传统形成的历史语境进行了研究。 Ancient China has a long history of legal interpretation of tradition, the tradition was formed in the Han Dynasty, and the development of the classics quite. Compared with western annotation jurisprudence, ancient Chinese legal interpretation tradition has its own characteristics, which depend on the characteristics of ancient Chinese political culture and academic development. This paper uses the perspectives and methods of hermeneutics to interpret the traditional historical context formed by ancient Chinese law.
