要求立法者积极推动基本权利的实施,与禁止立法者侵害基本权利,本身并无矛盾,因为不同的立法对基本权利产生的效应本就不同。如果进行类型化描述,可将立法对于基本权利产生的效应区分为:塑造特定基本权利的保护范围、作用于基本权利的规定范围与保护范围之“中间地带”、具体化针对基本权利的给付义务、具体化针对基本权利的国家保护义务、根据宪法的明文委托制定细则、纯粹干预或限制基本权利。依照针对基本权利产生的不同效应区分立法的类型,有助于为比例原则、传统的法解释规则、立法不作为等涉及立法之合宪性的判断话语寻找合理的栖身之所。
