拍卖保留价一直是拍卖实务中一个比较棘手的问题。一般而言,委托人希望拍卖保留价定得高些.以期获得更高的回报;而竟买人则望保留价定得低些,以便在竞拍中能以较低的价格竞得拍卖标的。笔者就目睹了这样的一宗有关拍卖保留价存在异议而致使拍卖最终失败的案例案例:某信用合作社清算组委托某拍卖公司拍卖住宅房屋一套,委托人与拍卖人在双方签订《委托拍卖合同》中注明了该标的的拍卖保留价以评估价为准。然而.在有关该标的的《估价鉴定结论书》中.某市价格认证中心作出了两个鉴定价格.一是鉴定总价值为82580元.
