我国在1991年《民事诉讼法》中引入督促程序之时,对待督促程序采用了单独设立章节的立法体例编排,这样一来就导致其至少在形式外观上既独立于特别程序又独立于简易程序,进而带来了对其属性的把握难题。鉴于对督促程序之属性的不同认识,往往会影响到司法实践中督促案件的相关具体操作规程,所以在理论上统一对督促程序属性的认识极其重要。本文首先对域外督促程序的定性进行了研究,又囿于案件的性质决定其所适用程序的属性,所以笔者又对督促案件与诉讼案件、非讼案件的特征进行了全面的对比,最终认为把督促程序的属性定位为“略式诉讼程序”最为合适。
When China introduced the supervisory procedure in the Civil Procedure Law of 1991, China adopted a separate legislative body for the procedure of supervision and administration, which led to its independence from the special procedure and the summary procedure, at least in its formal appearance , Which in turn brings with it the difficulty of grasping its properties. In view of the different understanding of the nature of the supervisory procedure, which often affects the specific operational procedures governing the supervision of cases in judicial practice, it is of paramount importance in theory to unite the recognition of procedural attributes. This dissertation first studies the nature of the procedure of extraterritorial supervision and the nature of the case determines the nature of the procedure to which it applies. Therefore, the author also makes a comprehensive comparison of the characteristics of supervising cases with those of litigation and non-litigation. Finally, It is most appropriate to supervise the properties of a program as “Slightly Litigation ”.
