不动产统一登记制度是2007年《物权法》的要求。不动产登记审查制度作为不动产登记制度的核心内容,对明确登记错误的责任承担、保障不动产登记的公示公信力、维护交易安全、促进交易效率等均有重要影响。然笔者以为今年3月1日姗姗来迟的《不动产登记暂行条例》(以下简称《条例》)及近日刚问世的《不动产登记暂行条例实施细则》(草案征求意见稿)(以下简称《意见稿》,在不动产登记机关审查义务的规定上仍过于原则,缺乏现实操作性,建议参照德、日的模式,在审查前适当引入公证制度,以简化不动产登记机构的审查程序,明晰不动产登记机构的审查义务,厘清不动产登记机构登记错误的责任承担,确保不动产登记制度更好地落实。
