构建城乡统一的建设用地市场,有助于打破城乡二元结构,缩小城乡经济差距;有助于缓解城市供地压力,提高土地使用的经济效率;有助于健全土地要素市场,实现土地所有权主体地位的平等;有助于强化农民权益保障,推进农民市民化。当前,我国城乡统一建设用地市场的构建主要面临四大现实困境:集体经营性建设用地法律性质定位不清;流转规划法律制度不健全;流转中政府职责(权力)定位不明;流转收益分配法律制度欠科学。须从四方面来加强相应制度创新,助推城乡统一建设用地市场的有效运行。
