“一个人被认为循环和呼吸功能不可逆转的丧失,或者整个脑功能(包括脑干)的丧失,即认为是死亡。”这是本文所提出的、适合于当前我国国情的区别死亡界限的标准。法律上的死亡确定必须与医学标准取得一致性。目前有35个国家在医学上接受脑死亡的新概念。但在法律上接受脑死亡标准仅仅14个国家。在不少国家、地区的立法机构和法学界人士对脑死亡概念,以及对脑死亡的法定认识感到迷惑不解,有的唯恐脑死亡法规的确立会促进安乐死的合法化。因而,区别死亡界限便成为医法学的热点。
“One is thought of as an irreversible loss of circulation and respiratory function, or loss of entire brain function, including the brainstem, which is considered death.” This is the standard proposed in this paper that is appropriate to the current death penalty in our country . Legal death must be determined in accordance with medical standards. At present, 35 countries accept the new concept of brain death in medicine. But in the law to accept the standard of brain death in only 14 countries. In many countries and regions, legislatures and legal scholars are puzzled by the concept of brain death and the statutory understanding of brain death. Some may fear that the establishment of brain death legislation will promote the legalization of euthanasia. Therefore, the distinction between the death line has become the hot point of medical law.
