善意取得在所有权领域的适用,是学者普遍认可的共识。但是,善意取得制度能否适用于担保物权领域,各国规定却不尽相同。我国早在2000年颁布实施的《最高人民法院关于适用<中华人民共和国担保法>若干问题的解释》第84条、第108条就分别确立了质权和留置权的善意取得,但是抵押权能否适用善意取得制度,一直没有明确规定。直至2007年《中华人民共和国物权法》施行,才明确了抵押权的善意取得制度。但是,该制度在理论和实践中仍有很多问题值得探讨。本文即以此为中心,对该制度进行价值分析和效力分析,抛砖引玉,求教大方。
The application of goodwill acquired in the field of ownership is a generally accepted consensus of scholars. However, whether the system of bona fide acquisition can be applied to the field of security interests, the regulations of different countries are not the same. As promulgated in Article 84 and Article 108 of the Interpretation of the Supreme People’s Court on Some Issues Concerning the Application of the Guarantee Law of the People’s Republic of China promulgated and enforced in 2000, the pledge of pledge and the right of lien were respectively established in good faith. However, The system of good faith acquisition has not been clearly defined. Until 2007, “People’s Republic of China Property Law”, only to clear the goodwill acquisition of the mortgage system. However, there are still many problems in the system in theory and practice worth exploring.
