《物权法》对地役权的变动采取了意思主义模式,而意思主义模式不利于区分物权和债权,混淆了地役权和不作为之债,不利于保护交易安全。意思是权利变动的起因,属于当事人主观思维的范畴,它必须通过有形的形式表现出来或者被外来力量所见证。本文认为在土地公有制下,我国物权立法地役权变动模式应采取形式主义。
Property Law adopted the mode of meaning doctrine on the change of easements, while the mode of meaning doctrine is not conducive to the separation of real rights and claims, obscuring the easement of servitude and inaction, and is not conducive to the protection of transaction security. Meaning means the cause of the change of rights belongs to the category of the subjective thinking of the parties. It must be manifested in the tangible form or witnessed by outside forces. This paper argues that under the public ownership of land, the mode of change of easement of the real right of real rights in our country should adopt formalism.
