认证是确定证据材料的证据能力和证明力的诉讼活动。认证规则是规范法官认证行为的规则总称 ,一般由认证程序规则、证据能力认证规则、证据证明力认证规则组成。我国应借鉴英美法系认证规则的合理因素 ,在证据能力方面建立合法性规则、真实性规则、相关性规则。证据证明力认证规则也是认证应当遵守的实体性规则 ,主要是指法律关于证据证明力大小与强弱的规定。 Accreditation is the evidence of the evidence to determine the material and evidence of litigation activities.
