政府规制部门由于缺乏足够的资源来监督违规行为,进而导致规制失败。如果在社会性规制中引入第三方认证,通过被规制企业聘请独立的第三方来验证其合规性,并促使其合规,便能够更好地实现规制目标。然而,第三方认证既有其优势,也隐藏着问题,主要表现为当私营部门行使本应是公共部门职能的时候能否保证问责制的实施,而且能否使公共利益得到保护。因此,政府规制部门需要制定和实施一些约束认证机构的制度,包括被规制企业如何选择认证机构,认证如何执行等。有了设计良好的制度和强有力的政府监督,第三方认证才能够更有利于社会性规制的实施。
Government regulation departments due to the lack of adequate resources to monitor irregularities, which led to the failure of regulation. If third-party certification is introduced into social regulation, regulatory objectives can be better achieved by hiring independent third parties to be tested for compliance and by enabling regulated companies to comply. However, third-party certification has both its advantages and hidden problems. It mainly shows whether the private sector can guarantee the implementation of the accountability system when exercising the function of the public sector should be exercised, and whether the public interest can be protected. Therefore, the government regulatory agencies need to develop and implement a number of constraints on the certification body’s system, including the regulated enterprises how to choose the certification body, how to implement the certification. With a well-designed system and strong government oversight, third-party certification can be more conducive to the implementation of social regulation.
