现行宅基地使用权制度立法的最初,崇尚的是社会法的价值理念,以对农民的生存保障功能作为首要的制度设计因素,构建了一套看似完备的制度对宅基地使用权的流转进行限制,以往土地市场的二元化运作机制使得农民在取得宅基地使用权的同时,也失去了享受土地增值收益的各种权利。随着农村经济市场化的不断演进,作为农村集体土地使用制度重要组成部分的宅基地使用权制度也应当顺应变革的浪潮,积极地参与改革与完善,这亦是我国土地政策完善和城乡一体化实现的必经阶段。
At present, the legislation of the system of usufruct right of homestead is advocating the value concept of social law. Taking the peasant’s subsistence guarantee function as the primary system design factor, we construct a set of seemingly complete system to transfer the right to use house sites. In the past, the dual operation mechanism of the land market made farmers lose the right to enjoy the land value-added income while acquiring the right to use house sites. As the marketization of rural economy continues to evolve, the system of right to use house sites as an important part of rural collective land use system should also follow the wave of change and be actively involved in the reform and improvement. This is also the result of the improvement of land policy and the integration of urban and rural areas The necessary stage of realization.
