现今,我国的WTO过渡期已经结束,但是与WTO不相适应的诸多规则和做法并没有随之逐步取消,外资的“超国民待遇”就是其中非常醒目的一条。在WTO规则下,外资“超国民待遇”不仅缺少理论依据;而且扭曲了国内市场的良性竞争秩序,降低了资源配置效率和社会福利水平。因此,在理论上,应当重新审视“超国民待遇”;在实践当中,应当严格界定国民待遇基准,减少地区性审批对国民待遇基准的扭曲,逐步取消外资“超国民待遇”。
Nowadays, the transitional period of our country has come to an end. However, many rules and practices incompatible with the WTO have not been phased out. The foreign super-national treatment is one of the most striking ones. Under the WTO rules, foreign capital “super national treatment ” not only lacks theoretical basis, but also distorts the healthy competition in the domestic market and reduces the efficiency of resource allocation and the level of social welfare. Therefore, in theory, we should re-examine “super national treatment ”; in practice, we should strictly define the national treatment benchmark, reduce the distortion of benchmarking of national treatment by regional examination and approval and gradually remove foreign capital “super national treatment ”.
